5. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

7. IS YOUR INFORMATION TRANSFERRED INTERNATIONALLY?


Our servers are located in the Dublin, Ireland. If you are accessing our Website from outside Ireland, please be aware that your information may be transferred to, stored, and processed by us in our facilities and by those third parties with whom we may share your personal information (see "WILL YOUR INFORMATION BE SHARED WITH ANYONE?" above), in Dublin, and other countries. European Commission's Standard Contractual Clauses:

We have implemented measures to protect your personal information, including by using the European Commission's Standard Contractual Clauses for transfers of personal information between our group companies and between us and our third-party providers. These clauses require all recipients to protect all personal information that they process originating from the EEA in accordance with European data protection laws and regulations. Our Standard Contractual Clauses can be provided upon request. We have implemented similar appropriate safeguards with our third-party service providers and partners and further details can be provided upon request.


8. HOW LONG DO WE KEEP YOUR INFORMATION?


We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy notice unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). No purpose in this notice will require us to keep your personal information for longer than seventy-two (72) months past the termination of the user's account. When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymise such information or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.


9. HOW DO WE KEEP YOUR INFORMATION SAFE?


We have implemented appropriate technical and organisational security measures designed to protect the security of any personal information we process.   • 12. CONTROLS FOR DO-NOT-TRACK FEATURES


    Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (DNT) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognising and implementing DNT signals has been finalised. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practise in a revised version of this privacy notice.


    13. DO CALIFORNIA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?


    California Civil Code Section 1798.83, also known as the "Shine The Light" law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year.     CCPA Privacy Notice

    The California Code of Regulations defines a "resident" as:

    1. Every individual who is in the State of California for other than a temporary or transitory purpose
    2. every individual who is domiciled in the State of California who is outside the State of California for a temporary or transitory purpose

    2. Participation in customer surveys or contests.
    3. Facilitation in the delivery of our Services and to respond to your inquiries.

    How do we use and share your personal information?

    Kudo Property Ltd collects and shares your personal information through:

  • We have no control over the essence and extent of these transmitted data as well as their additional processing. More information about our data collection and sharing practices can be found in this privacy notice.

If you are using an authorised agent to exercise your right to opt-out we may deny a request if the authorised agent does not submit proof that they have been validly authorised to act on your behalf.

    Will your information be shared with anyone else?

    We may disclose your personal information with our service providers according to a written contract between us and each service provider. Each service provider is a for-profit entity that processes the information on our behalf. We may use your personal information for our business purposes, such as sending you notifications on investment updates, and for undertaking internal research for technological development. This is not considered to be "selling" of your data. Kudo Property Ltd has disclosed the following categories of personal information to third parties for a business or commercial purpose in the preceding twelve (12) months:

    Identifiers, such as contact details, like your real name, alias, postal address, telephone or mobile contact number, unique personal identifier, online identifier, Internet Protocol address, email address, and account name.

    Category B
    Personal information, as defined in the California Customer Records law, such as your name, contact information, education, employment, employment history, and financial information.

    Category C
    Inferences are drawn from any of the personal information listed above to create a profile or summary about, for example, if an individual has a preference and characteristics. The categories of third parties to whom we disclosed personal information for a business or commercial purpose can be found under "WHO WILL YOUR INFORMATION BE SHARED WITH?"


    YOUR RIGHTS CONCERNING YOUR PERSONAL DATA

    Right to request deletion of the data - Request to delete

    You can ask for the deletion of your personal information. If you ask us to delete your personal information, based on whether you want to continue with your Kudo Property account, we will respect your request and delete your personal information, subject to certain exceptions provided by law, such as (but not limited to) the exercise by another consumer of his or her right to free speech, our compliance requirements resulting from a legal obligation or any processing that may be required to protect against illegal activities.

  • Right to be informed - Request to know Depending on the circumstances, you have a right to know: whether we collect and use your personal information;
  • The categories of personal information that we collect
  • The purposes for which the collected personal information is used
  • Whether we sell your personal information to third parties
  • The categories of personal information that we sold or disclosed for a business purpose;
  • The categories of third parties to whom the personal information was sold or disclosed for a business purpose; and
  • The business or commercial purpose for collecting or selling personal information.

  • In accordance with applicable law, we are not obligated to provide or delete consumer information that is de-identified in response to a consumer request or re-identify individual data to verify a consumer request. Right to Non-Discrimination for the Exercise of a Consumer’s Privacy Rights

    We will not discriminate against you if you exercise your privacy rights.

    Verification Process

    Upon receiving your request, we will need to verify your identity to determine you are the same person with whom we have the information in our system. These verification efforts require us to ask you to provide information so that we can match it with the information you have previously provided us. For instance, depending on the type of request you submit, we may ask you to provide certain information so that we can match the information you provide with the information we already have on file, or we may contact you through a communication method (e.g. phone or email) that you have previously provided to us. We may also use other verification methods as the circumstances dictate. We will only use the personal information provided in your request to verify your identity or authority to make the request. To the extent possible, we will avoid requesting additional information from you for the purposes of verification. If, however, we cannot verify your identity from the information already maintained by us, we may request that you provide additional information to verify your identity, and for security or fraud prevention purposes. We will delete such additionally provided information as soon as we finish verifying you.

    Other Privacy Rights

  • You may object to the processing of your personal data
  • You may request correction of your personal data if it is incorrect or no longer relevant, or ask to restrict the processing of the data
  • You can designate an authorized agent to request the CCPA on your behalf. We may deny a request from an authorised agent that does not submit proof that they have been validly authorised to act on your behalf in accordance with the CCPA.
  • You may request to opt-out from future selling of your personal information to third parties. Upon receiving a request to opt-out, we will act upon the request as soon as feasibly possible, but no later than 15 days from the date of the request submission.

    15. CALOPPA (CALIFORNIA ONLINE PRIVACY PROTECTION ACT)


    Although it does apply to California-based businesses as well, CalOPPA pertains to any company that collects personal information from California residents regardless of where that company is located. Because of the global nature of the internet, this law not only applies to almost any business in the United States, but it can also be (and has been) enforced in other countries as well. In our case, as we have traffic from all over the world so our privacy policy complies with the CalOPPA as well. Note: CalOPPA requires that all information you collect about Visitors be listed within the Privacy Policy. This includes both the information collected directly from users, data that is collected automatically such as IP address, and data collected from visitors such as email, etc. We provide all such information in our privacy policy so we fulfil the criteria of CalOPPA requirement


    16. DO WE MAKE UPDATES TO THIS NOTICE?


    Yes, we will update this notice as necessary to stay compliant with relevant laws. We may update this privacy notice from time to time. The updated version will be indicated by an updated "Revised" date and the updated version will be effective as soon as it is accessible.
